1. Introduction

Welcome to EXPK7.

These Terms and Conditions ("Terms") govern your access to and use of the EXPK7 website, mobile application, and related services (collectively referred to as the "Platform").

By accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.

2. About EXPK7

EXPK7 is a technology platform that enables customers to book and manage doorstep car wash services through subscription plans and on-demand service options.

Our services are available only in locations where EXPK7 operates.

3. Definitions

For the purpose of these Terms:

• "Company," "EXPK7," "we," "our," or "us" refers to EXPK7.
• "User," "Customer," "you," or "your" means any person accessing or using the Platform.
• "Platform" means the EXPK7 website, mobile applications, and related services.
• "Subscription Plan" means any recurring or fixed-duration service plan offered by EXPK7.
• "On-Demand Service" means a one-time car wash service booked through the Platform.
• "Service Partner" means an individual assigned by EXPK7 to perform the booked service.

4. Eligibility

To use the Platform, you must:

• Be at least 18 years of age.
• Be legally capable of entering into a binding contract.
• Provide accurate and complete registration information.
• Comply with all applicable laws while using the Platform.

By using the Platform, you represent and warrant that you satisfy these eligibility requirements.

5. User Account

To access certain features of the Platform, users may be required to create an account.

You agree to:

• Provide accurate information.
• Keep your account information updated.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activities carried out through your account.

EXPK7 shall not be liable for losses arising from unauthorized use of your account due to your failure to maintain account security.

6. Email OTP Authentication

EXPK7 uses Email OTP verification to authenticate user accounts.

By using the Platform, you agree that:

• OTPs are confidential.
• OTPs should not be shared with anyone.
• OTPs are valid only for the specified duration.
• Any OTP generated will invalidate previously generated OTPs.
• EXPK7 reserves the right to limit OTP requests to prevent misuse.

Users are responsible for ensuring that they have access to their registered email address.

7. Services Offered

EXPK7 may provide:

• Monthly subscription plans.
• Alternate-day subscription plans.
• On-demand car wash services.
• Service scheduling.
• Service history.
• Before and after wash photographs.
• Payment receipts.
• Customer support.

Service availability may vary depending on location and operational capacity.

8. Service Booking

When booking a service, users agree to:

• Provide accurate vehicle details.
• Provide the correct service address.
• Ensure the vehicle is accessible at the scheduled time.
• Ensure a safe environment for our Service Partner.

Failure to provide accurate information may result in delays, cancellation, or inability to complete the service.

9. Subscription Plans

Subscription plans are subject to the specific terms displayed at the time of purchase.

Subscription validity, service frequency, pricing, and inclusions may vary depending on the selected plan.

Unused services may not be carried forward unless specifically stated otherwise.

10. Auto-Renewal of Subscription

Certain subscription plans offered by EXPK7 may include an optional Auto-Renewal feature.

Where a customer chooses to enable Auto-Renewal, the following terms shall apply:

• By enabling Auto-Renewal, the customer authorizes EXPK7 to automatically charge the selected payment method for the applicable subscription fee at the end of each subscription period, unless Auto-Renewal is disabled before the renewal date.
• The renewed subscription shall be subject to the pricing, duration, and terms applicable at the time of renewal unless otherwise communicated by EXPK7.
• Customers may disable Auto-Renewal at any time through the Platform before the next scheduled renewal. Disabling Auto-Renewal will prevent future automatic renewals but will not affect the current active subscription.
• EXPK7 may send renewal reminders or renewal confirmations through email, in-app notifications, or other available communication channels. However, the inability of a customer to receive such notifications shall not affect the validity of a successful renewal.
• Auto-Renewal is subject to successful payment authorization. If the payment cannot be processed for any reason, the subscription may expire, be suspended, or remain inactive until a successful payment is completed.
• EXPK7 reserves the right to discontinue or modify the Auto-Renewal feature at any time. Where reasonably practicable, customers will be notified of any material changes.
• The customer is solely responsible for managing the Auto-Renewal setting associated with their subscription. Failure to disable Auto-Renewal before the renewal date shall be deemed as authorization to renew the subscription in accordance with these Terms and Conditions.

11. Customer Responsibilities

Customers agree to:

• Cooperate with assigned Service Partners.
• Ensure access to the vehicle.
• Ensure that the vehicle is properly locked and securely parked at the scheduled service location before the commencement of the service. Maintain respectful behaviour towards Service Partners.
• Report issues promptly through the Platform.

EXPK7 provides exterior car wash services only. Customers are responsible for ensuring that their vehicle is properly locked before the scheduled service. EXPK7 and its Service Partners shall not be responsible for any loss or damage arising from a vehicle being left unlocked.

12. Service Completion

A service shall generally be considered completed once:

• The assigned Service Partner completes the scheduled service.
• Required service updates are recorded.
• Before and after service photographs are captured, where applicable.
• The service status is updated in the Platform.

Customers are encouraged to review the service upon completion and promptly report any concerns through the Platform.

13. Pricing and Payments

All prices displayed on the Platform are quoted in Indian Rupees (INR) unless otherwise specified.

Users agree to pay the applicable charges for the selected services or subscription plans at the time of booking.

Payments may be made through the payment methods made available on the Platform.

A booking or subscription shall be considered confirmed only after successful payment authorization and confirmation.

EXPK7 reserves the right to revise service pricing, subscription charges, promotional offers, or discounts at any time. Such revisions shall not affect services already confirmed unless otherwise communicated.

For subscription plans with Auto-Renewal enabled, the applicable subscription charges will be automatically charged to the customer's selected payment method in accordance with these Terms and Conditions.

14. Payment Confirmation

Upon successful payment, EXPK7 will generate a payment receipt for the transaction.

Customers are advised to retain the payment receipt for future reference.

If a payment is debited but the booking is not confirmed due to a technical issue, users should contact EXPK7 Customer Support for assistance.

15. Service Scheduling

Customers may schedule services based on the available dates and time slots displayed on the Platform.

While EXPK7 will make reasonable efforts to provide services within the selected schedule, exact service timings cannot be guaranteed due to operational requirements, weather conditions, traffic, or other unforeseen circumstances.

EXPK7 reserves the right to reschedule services whenever reasonably necessary.

16. Customer Availability

Customers are responsible for ensuring that:

• The vehicle is available at the scheduled service location.
• The assigned Service Partner has reasonable access to the vehicle.
• The vehicle is properly locked before the scheduled service.
• The service location is safe and accessible.

If the vehicle is unavailable, inaccessible, or cannot be serviced for reasons attributable to the customer, the scheduled service may be treated as completed or rescheduled in accordance with the applicable subscription terms and company policies.

17. Service Delays and Rescheduling

While EXPK7 strives to provide timely services, delays may occur due to circumstances beyond our reasonable control, including but not limited to:

• Heavy traffic.
• Adverse weather conditions.
• Public holidays.
• Vehicle breakdowns.
• Staff emergencies.
• Government restrictions.
• Other unforeseen operational circumstances.

Where reasonably practicable, EXPK7 will notify customers regarding significant delays or rescheduling.

18. Cancellation by Customer

Cancellation of booked services or subscription plans shall be governed by the EXPK7 Refund and Cancellation Policy.

Customers are encouraged to review the applicable policy before making any booking or purchase.

19. Cancellation by EXPK7

EXPK7 reserves the right to cancel, postpone, or refuse any booking where:

• Service cannot be safely performed.
• Incorrect or misleading information has been provided.
• The service location is inaccessible.
• Severe weather conditions prevent service delivery.
• Operational constraints make service impossible.
• Circumstances beyond our reasonable control prevent performance.

Where applicable, affected customers shall be informed through the Platform, email, or other available communication channels.

20. Service Limitations

EXPK7 provides exterior car wash services only unless specifically stated otherwise.

The services offered through the Platform do not include vehicle repairs, mechanical work, paint correction, detailing, dent removal, or any other services not expressly described on the Platform.

Customers should carefully review the service inclusions before making a booking.

21. Prohibited Activities

Users shall not:

• Provide false or misleading information.
• Use the Platform for unlawful purposes.
• Interfere with the operation of the Platform.
• Attempt unauthorized access to the Platform or its systems.
• Misuse promotional offers.
• Harass, threaten, abuse, or behave inappropriately towards EXPK7 employees or Service Partners.
• Impersonate another individual or entity.
• Engage in fraudulent payment activities.

Violation of these Terms may result in suspension or termination of the user account.

22. Suspension and Termination

EXPK7 reserves the right to suspend, restrict, or terminate access to the Platform, with or without prior notice, if a user:

• Violates these Terms.
• Engages in fraudulent or illegal activities.
• Misuses the Platform.
• Repeatedly disrupts service operations.
• Threatens the safety of Service Partners or other users.

Termination of an account shall not affect any rights or obligations accrued prior to such termination.

23. Intellectual Property

All intellectual property rights relating to the Platform, including but not limited to:

• EXPK7 name.
• Logo.
• Software.
• Mobile applications.
• Website.
• Designs.
• Graphics.
• Text.
• Images.
• Videos.
• Trademarks.
• Service marks.
• Databases.
• Source code.

are owned by or licensed to EXPK7 and are protected under applicable intellectual property laws.

Users shall not copy, reproduce, distribute, modify, reverse engineer, or otherwise exploit any part of the Platform without the prior written permission of EXPK7.

24. Disclaimer of Warranties

The Platform and the services provided by EXPK7 are offered on an "as is" and "as available" basis.

While EXPK7 makes reasonable efforts to provide reliable and satisfactory services, we do not guarantee that:

• The Platform will operate without interruption or errors.
• Services will always be available at every location or time.
• The Platform will be free from technical issues or unforeseen interruptions.

To the maximum extent permitted by applicable law, EXPK7 disclaims all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

25. Limitation of Liability

To the fullest extent permitted by applicable law, EXPK7, its owners, employees, service partners, affiliates, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

• Use or inability to use the Platform.
• Delay, interruption, or cancellation of services.
• Technical failures or system errors.
• Loss of data or business opportunities.
• Acts or omissions beyond the reasonable control of EXPK7.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

26. Indemnification

You agree to indemnify, defend, and hold harmless EXPK7, its owners, employees, service partners, affiliates, and representatives from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to:

• Your breach of these Terms.
• Your misuse of the Platform.
• Your violation of any applicable law.
• Your infringement of the rights of any third party.

27. Force Majeure

EXPK7 shall not be liable for any delay, interruption, or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to:

• Natural disasters.
• Floods.
• Fire.
• Earthquakes.
• Pandemic or epidemic.
• Government restrictions.
• War.
• Civil unrest.
• Strikes.
• Power failures.
• Internet or communication failures.
• Other unforeseen events.

During such events, EXPK7 may suspend, postpone, or reschedule services until normal operations can reasonably resume.

28. Privacy

Your use of the Platform is also governed by the EXPK7 Privacy Policy, which explains how we collect, use, store, and protect your personal information.

By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

29. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, unless otherwise required by applicable law.

30. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

31. No Waiver

Failure by EXPK7 to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision.

Any waiver shall be effective only if made in writing by an authorized representative of EXPK7.

32. Changes to these Terms

EXPK7 reserves the right to modify or update these Terms and Conditions at any time.

Any revised Terms shall become effective upon publication on the Platform unless otherwise specified.

Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

34. Entire Agreement
